Booking Conditions

Contractual terms of the tourist rental between the guest and the landlord. Please read them carefully: confirming a booking constitutes acceptance of these terms.

1. Parties to the contract

The tourist rental contract is concluded exclusively between the guest (hereinafter the "tenant") and the private landlord:

Hotel Hambros Il Parco (Garis S.r.l.) is not a party to the rental contract and solely provides the ancillary service of key collection and return. All communications, requests or claims relating to the stay must be addressed exclusively to the landlord.

2. Booking and payment

The booking is confirmed exclusively upon receipt of advance payment of the full stay amount, to be made via:

Failure to pay within 48 hours of receiving the payment request will result in automatic cancellation of the booking without further notice.

3. Nature of payment and withdrawal

The amount paid in advance constitutes a penalty deposit (caparra penitenziale) pursuant to Art. 1386 of the Italian Civil Code. In the event of withdrawal from the contract by the tenant for any reason — including, by way of example: cancellation, date modification, no-show or early departure — the full amount paid shall be retained by the landlord and nothing shall be owed to the tenant by way of refund. Should the landlord withdraw from the contract for reasons attributable to the landlord, the landlord shall pay the tenant double the amount paid, pursuant to Art. 1386, paragraph 2, of the Italian Civil Code.

4. Supervening impossibility due to law

In the event of supervening legal impossibility of performance — and only in such case — arising from mandatory measures imposed by the authorities (such as travel bans between regions or provinces, compulsory closure of accommodation facilities ordered by law, Prime Ministerial Decrees or decree-laws rendering the stay legally impossible to perform), the contract shall be terminated by operation of law. In such case, the provisions of the Italian Civil Code governing the termination of contracts due to supervening impossibility shall apply, including those relating to the restitution of the amounts paid.

Circumstances of a personal or subjective nature relating to the tenant (such as illness, injury, voluntary quarantine, work or family impediments, flight or transport cancellations or delays, adverse weather conditions) are expressly excluded from the scope of this article and remain fully subject to Article 3.

The landlord strongly recommends that the tenant take out a travel insurance policy covering the risks of cancellation, illness and other personal impediments.

5. Security deposit

At check-in, the landlord may require the tenant to pay a security deposit as a guarantee against any damage to the apartment or its contents, equal to 10% of the total stay amount and in any case no less than €150.00. The deposit may be paid in cash or by credit card and shall be fully refunded at check-out, subject to verification of the condition of the apartment, without prejudice to the landlord's right to retain all or part of it to cover ascertained and documented damage.

6. Damage to the apartment

Any damage to the apartment or its contents shall be charged to the credit card provided at the time of booking. Should the card be unavailable or have insufficient funds, the damage shall be deducted from the security deposit referred to in Article 5, without prejudice to the landlord's right to claim further damages.

7. Check-in and check-out

Check-in: from 2:00 PM to 6:00 PM, unless otherwise agreed in advance with the landlord. Check-out: by 10:00 AM. Unauthorised late check-out may result in an additional night being charged.

8. Use of the apartment

The guest undertakes to use the apartment with the utmost care and diligence, not to exceed the number of occupants stated in the booking, and to comply with the house rules. Parties or events are not permitted.

9. No-smoking policy

Smoking is strictly prohibited in all indoor areas of the apartment, including traditional cigarettes, electronic cigarettes and heated tobacco devices. Violation of this prohibition will result in a flat penalty charge of €200.00 to cover washing and sanitising operations.

10. Pets

Pets of any kind are not permitted, including dogs and cats.

11. Exclusion of liability

The landlord is not liable for theft, loss of or damage to guests' personal belongings. Guests are advised to close doors and windows when leaving the apartment. The landlord shall not be liable for disruptions or interruptions in utility services caused by sudden and unforeseeable faults attributable to third-party suppliers, without prejudice to the obligation to take prompt action to restore service. The landlord's liability for wilful misconduct or gross negligence remains unaffected.

12. Applicable law and jurisdiction

This contract is concluded between private individuals, the landlord does not act as a professional, and is governed by Italian law. For any dispute relating to the interpretation or performance of these conditions, the Court of Lucca shall have exclusive jurisdiction.

13. Acceptance of conditions

By making payment for the stay and/or ticking the dedicated acceptance box during the booking request, the tenant declares that they have read, understood and fully accepted these Booking Conditions, with particular reference to the clauses relating to the penalty deposit (Art. 3), the security deposit (Art. 5), the no-smoking policy (Art. 9) and jurisdiction (Art. 12).
